AGBS. Provides information on our website (the “Site”) subject to the following terms and conditions (the “Terms of Use”). The terms “we,” “our,” “us,” and AGBS” refer to Africa Global Business Summit, and its subsidiaries. The term “you” refers to each individual user of this site and, if applicable to your use, your employer or firm. By accessing or using the site, you are acknowledging that you have read, understand, and agree, without limitation or qualification, to be bound by these Terms of Use and our Privacy Policy. If you disagree with these Terms of Use and our Privacy Policy (as amended from time to time) or are dissatisfied with this Site, your only remedy is to discontinue using this Site.

Please review the AGBS Privacy Policy, which also governs your visit to the site, so that you may understand our general privacy practices.
This Privacy Policy applies where we are acting as data manager with respect to the personal or corporate data of you or your organization as a visitor to our websites and as a user of the summit platforms and/or services, in other words, where the summit determines the purposes and means of the processing of your personal or corporate data.
We have developed this Privacy Policy to describe how and what type of personal data will be collected from users of the summit websites and/or platforms and the purposes, for which the summit may collect, share or disclose the personal data.
By using our websites, platforms, or through the summit social media pages or applications on third-party social networks (e.g. Facebook, Instagram, linkedin etc) or by giving us your personal data when registering for our events or other services, you accept the collecting and processing of your personal data as described in this Privacy Policy. If you do not agree to this Privacy Policy, please do not use Forum Sites or give us any personal data.
This Privacy Policy applies to any information obtained by us through your use of the AGBS Sites. It is not applicable to any websites controlled by third parties not affiliated with the summit that the summit Site may link to (“Third Party Sites”). Please review the privacy statements of each of these Third Party Sites as the summit is not responsible for and has no influence on the content or the privacy practices of Third Party Sites.
The summit reserves the right to make changes to this Privacy Policy at any time. We encourage you to regularly review this Privacy Policy to make sure you are aware of any changes and how your personal data may be used.
The Information we collect and for what purpose
When you use our site we process personal data that you provide through the AGBS Site, for example, when you enter personal details (e.g. name, gender, address, email address, phone/fax number) on a registration page.
The AGBS may use the personal data that you provide to us with your consent for a specified purpose or when you interact with AGBS Sites or we process your data if we have legal basis, namely, with regards to your registration to AGBS events or your request of AGBS services.
How we may share your personal data
We do not share your personal data with any third party that intends to use it for direct marketing purposes, unless you have provided specific consent in relation to this.
AGBS may share your personal data with third parties for other purposes, but only in the following circumstances:
I. With your express consent
We will share personal data with third parties outside of the AGBS when we have your consent to do so. We require explicit opt-in consent for the sharing of any sensitive personal information.
II. For legitimate interests
We will share personal data based on legitimate interests as, for example, when you register for one of our events, except where such interests are overridden by your interests or fundamental rights, in which case we will request your explicit consent.
III. For processing of AGBS’s future events in other regions
We provide your personal data to the Forum’s subsequent events in other regions for legitimate business purposes, on a “need-to-know” basis, based on our instructions and in compliance with our Privacy Policy and any other appropriate confidentiality and security measures.
IV. For external processing (service providers)
We may engage service providers, agents or contractors to provide services on our behalf, including to administer AGBS Sites and services available to you. These third parties may come to access or otherwise process your personal data in the course of providing these services.
The Forum requires such third parties, who may be based outside the country from which you have accessed the AGBS Site or service, to comply with all relevant data protection laws and security requirements in relation to your personal data, usually by way of a written agreement.

We will share personal data with third parties outside of the AGBS if we have in good-faith belief that access, use, preservation or disclosure of the personal data is reasonably necessary to:

When transferring personal data internationally, we make sure that we comply with applicable laws and regulations, for example, by entering into agreements that will ensure that the recipients of your information maintain an adequate level of data protection.
Information collected within the European Economic Area (“EEA”) may, for example, be transferred to countries outside of the EEA for the purposes as described in this Policy. We utilize standard contract clauses approved by the European Commission, adopt other means under Swiss and European Union law and/or obtain your consent to legitimize data transfers from the EEA to any other countries or region.

Any information provided to AGBS by you is handled with utmost care and security, and will not be used in ways other than as set forth in this Privacy Policy, or in any site/area-specific policies, or in ways to which users have not explicitly consented. AGBS employs a range of technologies and security measures to protect the information maintained on AGBS systems from loss, misuse, unauthorized access or disclosure, alteration or destruction.
Scope and Accuracy of Information.
In making this Site available, no client, advisory, partners or professional relationship is implicated or established and neither AGBS nor any other person is, in connection with this Site, engaged in rendering auditing, accounting, tax, legal, advisory, consulting, or other professional services or advice. Neither this Site nor any content on or accessed through this Site shall be considered a substitute for the independent investigations and the sound technical and business judgment of the user of this Site and the user should consult with a professional advisor familiar with your factual situation for advice or service concerning specific matters.
AGBS attempt to be as accurate as possible when describing our organization and services on the Site; however, to the extent permitted by applicable law, we do not warrant that the services or content available on the Site are accurate, complete, reliable, current, or error-free.
Intellectual Property
AGBS is the express intellectual property of Eden integrated services limited (Eden) and Best Global business (BGB)
Unless otherwise noted, EDEN and BGB owns all content available on this Site, including but not limited to the text, photographs, images, graphics, video & audio clips, and any compilation or arrangement thereof (the “Content”). All Content is protected by international laws regarding copyrights, trademarks, trade secrets and other proprietary rights.
The trademarks, logos, and service marks displayed on the Site (collectively, the “Trademarks”) are owned by AGBS (EDEN & BGB) organizers of Africa Global Business Summit and are protected by international trademark laws. All other Trademarks not owned by us that appear on the Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by AGBS.
Limited License
AGBS grants you a limited, revocable, and non-exclusive license to access and make personal use of the Site. Please note that you may not frame or utilize framing techniques to enclose the Site or any portion thereof without our prior written consent.
The limited license set forth herein does not include the right to:(i) copy, modify or download, other than as expressly permitted, the Site or its Content (except caching or as necessary to view the Content); (ii) make any use of the Site or its Content other than for your personal informational purposes, and if applicable, for informational purposes for your employer or firm; (iii) create any derivative work based upon either the Site or its Content; or (iv) use any meta tags or any other “hidden text” utilizing the name or Trademarks of AGBS without our express written consent.

Disputes
With respect to any dispute regarding the Site, your rights and obligations and all actions contemplated by these Terms of Use shall be governed by international law or the law of the Federal Republic of Poland. Any dispute relating in any way to your visit to the Site shall be first resolved by negotiation or submitted to confidential arbitration before a single arbitrator, except that, to the extent you have in any manner violated or threatened to violate our intellectual property rights, we may seek injunctive or other appropriate relief, and you consent to exclusive jurisdiction and venue in such courts. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

If you believe that your work has been copied on the Site in a way that constitutes copyright breach, please send us an email contact@africaglobalsummit.com to notify us of such claim. For feedback, please allow a period of (90) Ninety-days to enable our administrative team review your opinions.

COVID-19 Waiver
COVID-19 is awfully infectious and is believed to spread very fast mainly from person-to-person contact. with the above precaution you are under obligation to practice physical distancing and wearing of a mask while at AGBS public function to protect yourself, your family members or other delegates at the summit. I understand that the risk of becoming exposed to or infected by COVID-19 while attending/participating in Activities may result from the actions or omissions of myself and/or others, including, but not limited to our employees, agents and representatives, participants or any other individual who may be present or in attendance.
I voluntarily agree to assume all risks and accept sole responsibility for any injury to myself and any member of my family (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I, or members of my family may experience or incur in connection with my participation in AGBS event.
I further understand that the event for which I signed up may be rescheduled, postponed, or moved to a virtual setting depending upon COVID conditions. I realize that any such rescheduling shall NOT entitle me to a right to a refund.
By registering for a AGBS event, I agree to adhere to the federal, state, and county guidelines in place at the time of the event, which are subject to change.
With full awareness and appreciation of the risks involved, I, hereby release, waive, discharge, and covenant not to sue AGBS or any related entity, EDEN or BGB its members, officers, agents, independent contractors, affiliates, employees, successors and assigns (collectively the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or my family or any third party related to COVID-19 or other injury/disease whether caused by the acts, omissions, and/or negligence of the Released Parties, any third-party at AGBS event, or otherwise, while participating in any such event. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of Released Parties, its board members, officers, employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in AGBS event.

AGBS reserves the right, in our sole discretion, to change these Terms of Use at any time by posting the changes on the Site. Any changes are effective immediately upon posting to the Site. Your continued use of the Site constitutes your agreement to all such terms and conditions.
If any provision of these Terms of Use shall be unenforceable or invalid under any applicable law or be so held by any applicable court decision, such unenforceability or invalidity shall not render these Terms of Use unenforceable or invalid. AGBS will amend or replace such provision with one that is valid and enforceable, and which achieves, to the extent possible, our original objectives and intent as reflected in the original provision.
Cancellation and Refund Policy for AGBS event tickets
Because of the nature of our legal obligation with Waldorf Astoria hotel, we request that you cancel at least (3) three months before our scheduled event date in this case before the 23rd of December 2022 if you so wish to cancel. This gives us the opportunity to sell off your reserved seat since it is ONLY a by invitation event. Cancellation must be done officially through our registered email and followed up with a call to AGBS reservation team. If you cancel your reserved and paid ticket as specified above, we will offer you an opportunity to transfer your seat to someone else or make you an alternative reservation at our next event, but we do not offer monetary refunds. However, if you do not cancel prior to the 3months deadline, you may lose the payment for the summit made for your seat reservation.
